Marketing & Legal Preferences

A guide to legal preferences and candidate marketing options at the point of registration.

When registering candidate's on the system it is vital that their legal basis is correctly set, as well as their marketing preferences. If you would like to communicate with your candidates via the system then you will need to make sure they are opted into marketing and that you have their permission to keep this information on file.

What are the three methods of marketing? 

Job Alerts are automatically generated emails which send from the system alerting you candidate's to adverts which match their preferences. You can learn more here

Email Marketing includes bulk emails sent via a candidate search. You can learn more here

SMS Marketing includes all SMS messages sent via the system. SMS functionality is an optional extra, and you should reach out to Support if you would like to add this ability to your system. 

How do I find the marketing options when creating a candidate?

Using the Email Add in

When using the email add in, you should make sure to click into the Marketing tab and opt the candidate into the relevant marketing option: 


Using the Chrome/LinkedIn Extension

When using the chrome extension you should click into the Marketing tab on the extension and ensure that you are opting the candidates into marketing if you plan to contact them via the three methods listed: 


Manually registering the candidate directly in the system

A Super User will be able to add the marketing questions to your manual registration form and mark these as mandatory so that all users will be prompted to complete these questions when registering candidates via People > New Person. 

What about when candidates register themselves or apply for an advert? 

Yes, candidate's can choose to be opted into email and SMS marketing, as well as job alerts. Similar to the manual registration form, a Super User should add the questions to the web registration form

It is important to note that you cannot make the question mandatory on the registration form as the question will appear as tick box to opt in, rather than a 'yes' or 'no' question: 

GDPR Legal Basis for Processing Candidates

When you're manually creating a candidate in Firefish or reprocessing a candidate via the Compliance To Do List, you must choose a legal basis for processing that candidate's data.

Firefish allows you to choose from the following options:

Here's a list of the different legal basis you can select and what they mean:

  • Consent Request: Creates the candidate and sends login details to direct them to login and accept the agreement with the option of an email being sent.

  • Consent Provided: Creates and agrees to the candidate agreement with the option of an email being sent. Can be used when you've received consent from a candidate. More information on this type of legal basis can be found on the ICO Website here

  • Legitimate Interest: Creates and agrees to the candidate agreement with the option of an email being sent. This can be used when you use a candidates data in ways they would reasonably expect and which have a minimal privacy impact, or where there is clear justification for the processing of their data.   • Not Applicable At This Stage: This is available when adding candidates to the system. It will just create the candidate without opting them into any agreement.
